§ 1 Preliminary Information

1. This Privacy Policy defines the principles of personal data processing collected through the website www.b4theshow.com(hereinafter referred to as the “Website”).

2. The owner of the Website and the data controller is B4THESHOW MEDIA Radosław Łuka, NIP 7642182549, hereinafter referred to as “B4THESHOW.”

3. Personal data collected by B4THESHOW through the Website is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation, also known as GDPR).

B4theshow takes special care to respect the privacy of Users visiting the Website.

§ 2 Type of Processed Data, Purposes, and Legal Basis

1. B4THESHOW collects information about natural persons conducting business or professional activities on their own behalf, as well as natural persons representing legal entities or organizational units without legal personality, to which the law grants legal capacity. All such individuals are hereinafter referred to as Users.

2. Users’ personal data is collected in the following cases:

a. when placing an order on the Website, for the purpose of executing the sales agreement. Legal basis: necessity for the performance of the sales agreement (Article 6(1)(b) of the GDPR).

b. Newsletter subscription – an informational bulletin, for the purpose of performing a contract for the provision of electronic services. Legal basis: the consent of the data subject for the performance of the Newsletter service contract (Article 6(1)(a) of the GDPR).

c. using the contact form service on the Website, for the purpose of performing a contract for the provision of electronic services. Legal basis: necessity for the performance of the contact form service contract (Article 6(1)(b) of the GDPR).

3. When placing an order on the Website, the User provides the following data:

a. email address

b. address details: postal code and city, as well as street name with house/apartment number.

c. first name and last name

d. contact phone number

4. When placing an order where the payer is a company, the scope of data is extended to include:

a. full company name

b. tax identification number (NIP)

c. Business Registry Number (REGON)

5. In the case of the Newsletter service, the User provides their email address.

6. When using the contact form service, the User provides the following data:

a. email address

b. first name and last name

c. phone number

d. company name, if the User represents a business entity

7. While using the Website, additional information may be collected, including but not limited to: the IP address assigned to the User’s computer or the external IP address of the Internet provider, domain name, browser type, access time, and operating system type.

8. Navigational data may also be collected from Users, including information about links and references they choose to click on or other activities undertaken on our Website. Legal basis: legitimate interest (Article 6(1)(f) of the GDPR), consisting of facilitating the use of electronic services and improving the functionality of these services.

9. For the purpose of establishing, pursuing, and enforcing claims, certain personal data provided by the User while using the functionalities of the Website may be processed, such as: first name, last name, data related to the use of services (if the claims arise from the manner in which the User uses the services), and other data necessary to prove the existence of a claim, including the extent of the damage incurred. Legal basis: legitimate interest (Article 6(1)(f) of the GDPR), consisting of establishing, pursuing, and enforcing claims, as well as defending against claims in proceedings before courts and other state authorities.

10. Providing personal data to B4THESHOW is voluntary in connection with sales agreements or the provision of services through the Website. However, failure to provide the data specified in the forms will prevent the User from placing and fulfilling an order.

§ 3 Information on Data Sharing, Entrustment, and Retention Period

1. The User’s personal data is shared with service providers used by B4THESHOW in the operation of the Website. Depending on contractual arrangements and circumstances, the service providers to whom personal data is shared either act on behalf of B4THESHOW, following its instructions regarding the purposes and methods of data processing (data processors), or determine the purposes and methods of data processing independently (data controllers).

a. Data processors – B4THESHOW uses service providers that process personal data exclusively on behalf of B4THESHOW. These include, among others, providers of hosting services, accounting services, marketing systems, website traffic analysis systems, and marketing campaign performance analysis systems.

b. Data controllers – B4THESHOW uses service providers that do not act exclusively on its instructions and independently determine the purposes and methods of processing Users’ personal data. They provide electronic payment and banking services.

2. Location – service providers are mainly based in Poland and other countries within the European Economic Area (EEA).

3. Users’ personal data is stored:

a. When the legal basis for processing personal data is consent, the User’s personal data is processed by B4THESHOW for as long as the consent is not withdrawn. After the consent is withdrawn, the data will be processed for a period corresponding to the statute of limitations for claims that B4THESHOW may assert or that may be asserted against it. Unless a specific provision states otherwise, the statute of limitations is six years, and for claims related to periodic benefits or those connected with business activities, the period is three years.

b. When the legal basis for processing personal data is the performance of a contract, the User’s personal data is processed by B4THESHOW for as long as it is necessary to perform the contract. After this period, the data will be processed for a period corresponding to the statute of limitations for claims. Unless a specific provision states otherwise, the statute of limitations is six years, and for claims related to periodic benefits or those connected with business activities, the period is three years.

4. Navigational data may be used to provide Users with better service, analyze statistical data, customize the Website according to Users’ preferences, and administer the Website.

5. If the User subscribes to the Newsletter – an informational bulletin – B4THESHOW will send electronic messages to the provided email address containing commercial information about promotions, new products and services available on the Website, as well as educational and instructional content.

6. In the event of a request, B4THESHOW provides personal data to authorized state authorities, in particular to organizational units of the Prosecutor’s Office, the Police, the President of the Personal Data Protection Office, the President of the Office of Competition and Consumer Protection, or the President of the Office of Electronic Communications.

§ 4 Cookie Mechanism, IP Address

1. The Website uses files called cookies, which are small text-based pieces of information. These files are stored by B4THESHOW on the end device of the person visiting the Website (e.g., a computer, smartphone, or tablet), provided the web browser allows it. Cookies can be read by the Operator’s IT system or other entities.

2. B4THESHOW stores cookies on the User’s end device and subsequently accesses the information contained within them for statistical, marketing, and proper website functioning purposes.

3. B4THESHOW informs Users that it is possible to configure their web browser to prevent cookies from being stored on the User’s end device.

4. B4THESHOW points out that cookies can be deleted by the User after they have been saved by B4THESHOW. This can be done using appropriate browser functions, software dedicated to this purpose, or by utilizing the appropriate tools available within the operating system the User is using.

6. B4THESHOW informs Users that changing the browser settings to prevent or limit the storage of cookies on the User’s end device may cause certain service functionalities to be restricted. Deleting cookies during service delivery may lead to similar consequences.

7. B4THESHOW may collect Users’ IP addresses. An IP address is a number assigned to a visitor’s computer by their Internet service provider. It allows access to the Internet and is typically assigned dynamically, changing with each Internet connection. B4THESHOW uses IP addresses for diagnosing technical server issues, conducting statistical analyses (e.g., determining the regions from which Website visits originate), and as information useful in administering and improving the Website. Additionally, IP addresses may be used for security purposes and for identifying unauthorized automated browsing tools that place strain on the server.

8. The Website contains links and references to other websites. B4THESHOW is not responsible for the privacy policies in effect on those external sites.

§ 5 Rights of Data Subjects

1. The right to withdraw consent – legal basis: Article 7(3) of the GDPR.

a. The User has the right to withdraw any consent they have given to B4THESHOW.

b. The withdrawal of consent takes effect from the moment it is withdrawn.

c. Withdrawing consent does not affect the processing carried out by B4THESHOW in accordance with the law prior to its withdrawal.

d. Withdrawing consent does not have any negative consequences for the User, but it may prevent further use of services or functionalities that B4THESHOW can legally provide only with consent.

2. The right to object to data processing – legal basis: Article 21 of the GDPR.

a. The User has the right, at any time, to object, on grounds related to their particular situation, to the processing of their personal data, including profiling, if B4THESHOW processes their data based on a legitimate interest, such as marketing B4THESHOW’s products and services, conducting usage statistics of certain Website functionalities, facilitating the use of the Website, and conducting satisfaction surveys.

b. Opting out of receiving marketing communications regarding products or services via email will constitute the User’s objection to the processing of their personal data, including profiling for these purposes.

c. If the User’s objection is justified and B4THESHOW has no other legal basis for processing the personal data, the User’s personal data to which the objection applies will be deleted.

3. The right to erasure (“the right to be forgotten”) – legal basis: Article 17 of the GDPR.

a. The User has the right to request the erasure of all or part of their personal data.

b. The User has the right to request the erasure of personal data if:

I. the personal data is no longer necessary for the purposes for which it was collected or processed

II. the User has withdrawn specific consent, insofar as the personal data was processed based on that consent

III. the User has objected to the use of their data for marketing purposes

IV. the personal data is being processed unlawfully

V. the personal data must be erased in order to comply with a legal obligation under Union law or the law of a Member State to which B4THESHOW is subject

VI. the personal data was collected in connection with the offering of information society services

c. Notwithstanding a request for erasure of personal data due to an objection or withdrawal of consent, B4THESHOW may retain certain personal data to the extent that processing is necessary to establish, exercise, or defend claims, as well as to comply with a legal obligation under Union law or the law of a Member State to which B4THESHOW is subject. This particularly applies to personal data such as name, email address, which may be retained for handling complaints and claims related to the use of B4THESHOW’s services. Additionally, for handling complaints and claims related to concluded sales agreements or service provisions, data such as the user’s residential/mailing address, company name, company address, identification numbers including tax identification number (NIP), and order number may also be retained.

4. The right to restrict data processing – legal basis: Article 18 of the GDPR.

a. The User has the right to request the restriction of the processing of their personal data. Submitting such a request, until it is resolved, prevents the use of certain functionalities or services that require the processing of the data covered by the request. B4THESHOW will also refrain from sending any communications, including marketing messages.

b. The User has the right to request restriction of the use of personal data in the following cases:

I. when the accuracy of their personal data is contested – in such cases, B4THESHOW restricts its use for the time needed to verify the accuracy of the data, but no longer than 7 days.

II. when the data processing is unlawful, and instead of deletion, the User requests that their use be restricted.

III. when the personal data is no longer needed for the purposes for which it was collected or used, but the User needs it to establish, exercise, or defend legal claims.

IV. when the User objects to the use of their data – in such cases, restriction occurs for the time needed to consider whether, due to the User’s particular situation, the protection of their interests, rights, and freedoms outweighs the interests pursued by the Controller through the processing of the User’s personal data.

5. The right of access to data – legal basis: Article 15 of the GDPR.

a. The User has the right to obtain confirmation from the Controller as to whether their personal data is being processed, and if so, the User has the right to:

I. gain access to their personal data

II. obtain information about the purposes of processing, the categories of processed personal data, the recipients or categories of recipients of this data, the planned retention period of the User’s data or the criteria used to determine that period (if specifying a planned processing period is not possible), the rights granted to the User under the GDPR, the right to lodge a complaint with a supervisory authority, the source of the data, automated decision-making (including profiling), and the safeguards used in connection with the transfer of data outside the European Union.

6. The right to rectify data – legal basis: Article 16 of the GDPR.

a. The User has the right to request that B4THESHOW promptly correct any inaccurate personal data concerning them. Taking into account the purposes of processing, the User whose data is concerned has the right to request the completion of incomplete personal data, including by providing an additional statement, by directing the request to the specified email address.

§7 of the Privacy Policy.

7. The right to data portability – legal basis: Article 20 of the GDPR.

a. The User has the right to receive their personal data, which they provided to B4THESHOW, and then transmit it to another data controller of their choice. The User also has the right to request that their personal data be sent directly by B4THESHOW to such a controller, provided it is technically feasible. In such cases, B4THESHOW will transmit the User’s personal data in a .csv file format, which is widely used, machine-readable, and suitable for transferring the received data to another data controller.

8. When a User exercises one of the rights described above, B4THESHOW will either comply with the request or refuse it promptly, but no later than one month after receiving it. However, if—due to the complexity of the request or the number of requests—B4THESHOW is unable to fulfill the request within one month, it will fulfill it within the following two months. In such cases, B4THESHOW will notify the User of the intended extension and the reasons for it within one month of receiving the request.

9. The User may submit complaints, inquiries, and requests to B4THESHOW concerning the processing of their personal data and the exercise of their rights.

10. The User has the right to request B4THESHOW to provide a copy of the standard contractual clauses by submitting a query as specified in §7 of the Privacy Policy.

11. The User has the right to lodge a complaint with the President of the Personal Data Protection Office concerning any breach of their personal data protection rights or other rights granted under the GDPR.

§ 6 Security Management

1. B4THESHOW provides Users with a secure and encrypted connection when transmitting personal data. B4THESHOW uses an SSL certificate issued by a company specialized in data security and encryption over the Internet.

§ 7 Amendments to the Privacy Policy

1. The Privacy Policy may be amended, and B4THESHOW will inform Users at least 7 days in advance.
